1. About these Terms

These Terms and Conditions (“Terms”) govern your use of bzubzi.com and any related pages or services (the “Website”), as well as purchases and downloads made through the Website.

The Website operates under the brand Bzubzi Studio. The legal seller and operator is:

Bzubzi Studio A. Orlowska
ul. Serwituty 25
02-233 Warsaw, Poland, European Union
Tax Identification Number (NIP): 1132383091
EU VAT ID: PL1132383091
Email: hello@bzubzi.com

In these Terms, “Bzubzi Studio,” “we,” “us,” and “our” refer to the legal seller identified above. “You” means any person who visits the Website, downloads free content, or purchases a product.

By using the Website, you agree to these Terms. When you place an order, the version of the Terms made available to you at checkout forms part of your purchase contract. Nothing in these Terms limits any mandatory rights you have under applicable consumer law.

2. Adults, Parents, and Children

The Website and store are intended for adults. You must be at least 18 years old, or have legal capacity under the law applicable to you, to place an order, join the mailing list, or submit a contact form.

Our stories are created for children, but purchases, downloads, account activity, and communications with us should be completed by a parent, legal guardian, teacher, or other responsible adult. Children may enjoy the stories and Website content with appropriate adult involvement.

We do not knowingly collect personal information directly from children.

3. Digital Products

Unless a product page expressly states otherwise, products sold through the Website are digital products supplied electronically, such as PDF ebooks, printable stories, coloring pages, activity pages, or audio files. No physical product will be shipped.

Each product page describes the main characteristics of the product, its format, price, and any specific technical or usage information. Product images are illustrative, but the delivered product will materially correspond to its description.

PDF products require a device and software capable of opening PDF files. Printing requires access to a compatible printer and may produce results that vary according to the printer, paper, ink, and settings used. You are responsible for ensuring that your device and software meet the requirements stated on the relevant product page.

4. Prices, Orders, and Payment

Prices and the currency used are displayed on the relevant product page and at checkout. Any applicable taxes or additional charges will be shown before you place your order, where required.

Payment is processed using the payment methods offered at checkout. Payment services may be provided by third-party payment processors and may be subject to their own terms and privacy policies.

Before placing an order, you will have an opportunity to review the selected products, total price, and information you have entered. You are responsible for providing accurate billing and email information.

Your order constitutes an offer to purchase the selected product. A purchase contract is formed when payment is successfully authorized and we send or display an order confirmation, unless applicable law provides otherwise.

We may cancel and refund an order where payment has not been authorized, there is an obvious pricing or technical error, fraud is reasonably suspected, or fulfilling the order would violate applicable law.

5. Delivery and Access

Digital products are normally made available after successful payment through the order-confirmation page, a download link sent by email, or both. If you create an account, available downloads may also appear in the Downloads section of your account.

Delivery may occasionally be delayed by payment processing, incorrect email details, spam filtering, hosting interruptions, or other technical problems. If you do not receive access within a reasonable time, contact hello@bzubzi.com and include your order number.

You are responsible for downloading and securely storing your purchased files. Any download limit or access period that applies will be disclosed at or before purchase.

6. Personal-Use License

When you purchase or lawfully download a digital product, you receive a limited, non-exclusive, non-transferable, revocable license to use it for your own personal and household use, subject to these Terms. Ownership of the product and all intellectual-property rights remains with Bzubzi Studio or the relevant rights holder.

You may:

  • download and store the file on your personal devices;
  • read it on a compatible device; and
  • print copies for use within your own household.

Unless we give you prior written permission or a separate license expressly allows it, you may not:

  • share, forward, upload, publish, distribute, lend, sublicense, or resell the file or download link;
  • reproduce copies for another household, school, classroom, library, organization, or commercial setting;
  • modify, translate, adapt, extract, or create derivative products from the content;
  • remove copyright, authorship, trademark, or other proprietary notices;
  • use the content, characters, illustrations, or text to train an artificial-intelligence system or build a dataset; or
  • use the product or any part of it for commercial purposes.

For classroom, library, event, organizational, translation, adaptation, or commercial licensing, contact hello@bzubzi.com before use.

7. Free Downloads and Email Communications

We may offer free digital content in exchange for an email address. Free downloads are licensed for personal and household use under the same rules described in Section 6 unless the offer states otherwise.

Where the signup form states that you will also receive emails from Bzubzi Studio, those emails may include new stories, products, activities, news, or special offers. You may unsubscribe at any time using the link included in each marketing email. Unsubscribing does not cancel the personal-use license for a file you have already lawfully downloaded.

Our handling of personal information is explained in our Privacy Policy.

8. Right of Withdrawal and Refunds for Digital Content

Consumers may have a statutory right to withdraw from a distance contract within 14 days. Different rules apply when digital content is supplied immediately and is not delivered on a physical medium.

If you ask us to provide paid digital content immediately, before the end of the statutory withdrawal period, we will request your prior express consent to begin supplying it and your acknowledgment that you lose the statutory right of withdrawal once supply begins. We will confirm this information with the order confirmation or on another durable medium as required by law.

After access to the digital content has begun with the legally required consent and acknowledgment, we do not offer a voluntary change-of-mind refund unless the product page expressly says otherwise. This does not affect your rights if the file is not supplied, is defective, is materially different from its description, or applicable law otherwise requires a remedy.

If the legally required consent or acknowledgment has not been obtained, your statutory rights remain unaffected.

For customers outside the European Economic Area, any refund or cancellation rights required by the mandatory law applicable to the customer will continue to apply.

9. Problems With Digital Content and Complaints

We are responsible for supplying digital content that conforms to the purchase contract and applicable law.

If you cannot access a purchased file, receive the wrong file, or believe that the digital content is defective or does not conform to its description, contact hello@bzubzi.com. Please provide:

  • your name and order number;
  • the email address used for the order;
  • a description of the problem; and
  • screenshots or other useful technical details, if available.

Where required by applicable consumer law, you may ask us to bring the digital content into conformity. If that is impossible, is not completed within a reasonable time, or causes significant inconvenience, you may be entitled to an appropriate price reduction or to terminate the contract and receive a refund, subject to the conditions imposed by applicable law.

We will respond to consumer complaints within 14 days unless a shorter mandatory period applies. Your statutory consumer rights are not limited by these Terms.

9A. Refund Policy for Digital Products

Our stories are digital products delivered as downloadable PDF files. Because a file can be copied as soon as it has been downloaded, we handle refunds as described below. This policy applies together with Sections 8 and 9 and does not limit any rights you have under mandatory law. When we will refund or fix your order
  • Missing or inaccessible file. If you did not receive your download or the link does not work, we will first help you get access. If we cannot do so within 14 days of your message, we will refund the order in full.
  • Wrong or damaged file. If the file is not the product you ordered, is corrupted, or cannot be opened with compatible PDF software, we will send you a correct file. If we cannot, we will refund the order in full.
  • Not as described. If the product is materially different from its description on the product page, contact us and we will correct it or refund the order.
  • Accidental duplicate order. If you buy the same product twice by mistake, we will refund the duplicate order if you contact us within 7 days of purchase.
When we do not offer a refund
  • Change of mind. Once a download has been made available to you, we do not offer refunds because you changed your mind, no longer want the product, or your child has already read it, except where mandatory law gives you a right of withdrawal (see Section 8).
  • Printing results that differ because of your printer, paper, ink, or settings (see Section 3).
  • Orders where the file or download link was shared in breach of Section 6.
How to request a refund Email hello@bzubzi.com within 7 days of your purchase with your name, order number, the email address used for the order, and a short description of the problem. We will reply within 14 days. How refunds are paid Refunds are issued to the original payment method, in the currency of the original payment. The time it takes for the refund to appear depends on your bank or card issuer. This section does not apply to free stories.

10. Website and Intellectual Property

The Website and its content—including the Bzubzi character and story world, stories, illustrations, text, product names, logos, graphics, downloads, videos, audio, design, and other materials—are owned by or licensed to Bzubzi Studio and are protected by copyright, trademark, and other intellectual-property laws.

You may browse the Website for personal, non-commercial purposes. Except for the limited licenses expressly granted in these Terms, no right, title, or interest in the Website or its content is transferred to you.

You may not copy, reproduce, republish, scrape, distribute, sell, exploit, or create derivative works from Website content without prior written permission, except where mandatory law expressly permits the use.

11. Acceptable Use

You must not:

  • use the Website for unlawful, fraudulent, harmful, or abusive purposes;
  • attempt to gain unauthorized access to the Website, accounts, systems, or download files;
  • introduce malware, malicious code, automated scraping tools, or disruptive technology;
  • interfere with the Website’s security, operation, or another person’s use of it;
  • impersonate another person or provide false payment or contact information; or
  • use the Website or its content in a way that infringes another person’s rights.

We may restrict access where reasonably necessary to protect the Website, our rights, our customers, or third parties, or to comply with law.

12. Messages, Reviews, and Other Content You Send

Messages sent through the contact form or by email remain yours. Sending a message does not give us permission to publish your name, your child’s name, your review, photographs, artwork, or other personal content for marketing purposes.

If we would like to publish a testimonial, image, or other material you provided, we will ask for appropriate permission separately. Please do not send content that you do not have the right to share.

13. Third-Party Services and Links

The Website may contain links to or integrations with third-party services, including payment processors, email providers, social-media platforms, and external websites. We are not responsible for third-party content, availability, security, or privacy practices. Your use of third-party services may be governed by their own terms and policies.

14. Availability and Security

We take reasonable steps to keep the Website and download systems available and secure, but we cannot promise uninterrupted or error-free operation. We may temporarily suspend access for maintenance, security, technical, or legal reasons.

You are responsible for using appropriate device security, maintaining backups of downloaded files, and protecting any account credentials associated with the Website.

15. Liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including mandatory liability to consumers. Nothing in these Terms limits your statutory rights relating to digital content that is not supplied or does not conform to the contract.

To the maximum extent permitted by applicable law, we are not responsible for losses caused by events beyond our reasonable control, incompatibility that was clearly disclosed before purchase, misuse of the Website or files, or unauthorized sharing or modification of the content.

If you use the Website or products for purposes connected with a business, profession, school, organization, or other non-consumer activity without an appropriate license, any liability will be limited to the extent permitted by applicable law.

16. Privacy

Our Privacy Policy explains how and why we collect, use, store, and share personal information, as well as the rights available to you. The Privacy Policy should be read together with these Terms, but it does not replace or reduce any rights you have under data-protection law.

17. Changes to These Terms

We may update these Terms when our Website, products, business details, or legal obligations change. The updated date will be shown at the top of the page.

Changes apply prospectively. A purchase remains governed by the Terms provided or made available when the order was placed, unless a change is required by law or you expressly agree otherwise.

18. Governing Law and Disputes

These Terms and contracts made through the Website are governed by Polish law. If you are a consumer, this choice of law does not deprive you of mandatory consumer protections available under the law of your country of habitual residence.

Disputes may be brought before the courts that have jurisdiction under applicable law. Nothing in these Terms requires a consumer to bring a claim exclusively in Warsaw or prevents a consumer from using any court or remedy available under mandatory law.

We encourage you to contact us first so that we can try to resolve the issue directly. After an unsuccessful complaint, a consumer may seek assistance from an appropriate consumer-protection body or use an available out-of-court dispute-resolution procedure. Information about Polish consumer dispute resolution is available at https://polubowne.uokik.gov.pl/. Participation in a particular procedure will depend on the applicable legal requirements and our agreement where consent is required.

19. Severability and Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

These Terms, together with the product description, order information, Privacy Policy, and any other terms expressly presented at checkout, form the agreement relating to your use of the Website and purchase of digital products.
